If you agree with that, then you might NOT be a mediator.
Ask either of these questions:
- Who prepares the pre-mediation statement?
- To whom does the mediation belong?
Ask yourself:
- Why are interrogatories so often less effective in discovery than depositions?
- Who prepares the Answers to interrogatories?
- Does the mediation always “track” the pre-mediation statements?
- Audience?
How might mediation make a difference?
